Jurisprudential study of the characteristics of prostitution and overthrow

Abstract

The aim of the present study is to study the jurisprudential characteristics of prostitution and subversion, which was addressed using a descriptive-analytical method. The results showed that the main characteristics of prostitution are as follows: What is in the minds and consciences of individuals and is not clothed in the guise of external fulfillment cannot be considered as prostitution and subversive practice. An activity is considered to be in conflict with the system or the ruler, not a neutral and irrelevant activity. It is a violent and warlike act, and peaceful opposition cannot be called an outrage. Violence is a continuation of a specific malice (intent to overthrow or weaken).

یهدف البحث الراهن إلى دراسة فقهیة لخصائص البغی والإطاحة، وقد أُنجز بالمنهج الوصفی والتحلیلی. والسؤال المهم هو موضوعیة البغی للحکم فی القرآن والروایات ما هی خصائصه وإلى أیّ مدى نطاقه؟ أظهرت النتائج أنّ أهمّ خصائص البغی هی: أنّه عمل جوارحی؛ وما یدور فی أخلاد الأشخاص وأذهانهم ما لم یلتبس بالعمل الخارجی لا یعتبر بغیاً وإطاحةً؛ ویُعدّ نشاطاً مضادّاً للنظام أو الحاکم ولیس نشاطاً محایداً وغیر ذی صلة؛ وهو فعل عنیف وحربی ولا یمکن عدّ المعارضات السلمیة بغیاً؛ کما هو عنف مستمرّ یُمارَس لأضغانٍ محدّدة (بنیّة الإطاحة أو التقویض).
