قاعده‌ی حفظ نظام و پیوند آن با حفظ نظام سیاسی؛ با تاکید بر نگاه فقهی امام‌خمینی

چکیده

هدف این پژوهش واکاوی و شناسایی قاعده "حفظ نظام" و پیوند آن با حفظ "نظام سیاسی" در اندیشه فقهی امام‌خمینی است. روش پژوهش توصیفی-تحلیلی بوده و در راستای هدف پژوهش حاکمیت و عمومیت حفظ نظام اجتماعی، دلیل وجوب و حاکمیت حفظ نظام، قلمرو حفظ نظام در فقه، تلازم حفظ نظام عام و نظام خاص، حفظ نظام خاص سیاسی و حفظ نظام دین و کیان اسلام مورد بررسی قرار گرفت. نتایج نشان داد، تلازمی که امام‌خمینی میان حفظ نظام سیاسی موجود با حفظ نظام عام اجتماعی ازیک‌سو، و حفظ جایگاه و نقش و چهره‌ی اسلام ازسوی‌دیگر می‌دیدند، حفظ نظام جمهوری اسلامی را مهم‌ترین تکلیف یا از مهم‌ترین تکالیف دینی دانسته‌اند؛ خاستگاه این تکلیف در نگاه ایشان را، هم باید در پیوند مستقیم حفظ نظام با عملکرد نظام تحلیل کرد، و هم باید آن را در اقتضای وظیفه‌شناسی آحاد مکلفان در حفظ نظام در برابر دشمنان فهم نمود.

چکیده [English]

The aim of this study is to investigate and identify the rule of “maintenance of the system “and its relation with the protection of "political system” in juridical thought of Imam Khomeini .The method of this research is descriptive - analytic and in order to study the sovereignty and generality of maintenance the social system , the reason of the necessity and sovereignty of the system , maintenance the system in Islamic jurisprudence , the association of the maintenance of the general system and the special system , the maintenance of the political system and the maintenance of the regime of Islam were studied . The results showed that imam Khomeini’s order to maintain the existing political system with the maintenance of the social system, and preserve the status and face and face of Islam, consider maintaining the Islamic republic system the most important task or the most important religious duty. The origin of this task should be analyzed in direct connection maintenance of the system with performance of the system, and it should be understood by people’s fealty to protect the system against enemies.

قاعدة صیانة النظام وصلتها بحفظ النظام السیاسی مع التأکید على النظرة الفقهیة لدى الإمام الخمینی

چکیده [العربیة]

یهدف البحث إلى تحلیل ودراسة قاعدة "صیانة النظام" وصلتها بـ"صیانة النظام السیاسی" من خلال الرؤیة الفقهیة لدى الإمام الخمینی. منهج البحث هو المنهج الوصفی والتحلیلی، وفی سیاق البحث تمّ التعرّض لدراسة کلّ من حاکمیة وشمول صیانة النظام الاجتماعی، ودلیل وجوب صیانة النظام وحاکمیّته، وثغور وحدود صیانة النظام فی الفقه، والملازمة بین صیانة النظام العامّ والنظام الخاصّ، وصیانة النظام السیاسی الخاصّ، وصیانة نظام الدین الإسلامی وکیانه. تکشف النتائج عن أنّ الإمام الخمینی عندما کان یرى التلازم بین صیانة النظام السیاسی الماثل وصیانة النظام الاجتماعی هذا من جهة، ومن جهة أُخرى صیانة مکانة الإسلام ودوره وسمعته، فإنّه کان یرى أنّ صیانة نظام الجمهوریة الإسلامیة هی أهمّ الواجبات الدینیة أو من أهمّها؛ وبحسب نظره فإنّه ینبغی تحلیل منشأ هذا الواجب ضمن الصلة المباشرة بین صیانة النظام وأدائه، کما ینبغی فهمه أیضاً ضمن اقتضاءات واجبات المکلّفین فی صیانة النظام وحمایته من الأعداء.
